Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Bedtimey, including our website at bedtimey.com, our personalized continuing bedtime-story delivery service, family subscriptions, gift memberships, and related features.

By creating an account, starting a free trial, purchasing a subscription, buying or redeeming a gift membership, or otherwise using Bedtimey, you enter into a legally binding agreement with Bedtimey (“Bedtimey,” “we,” “us,” or “our”) and agree to these Terms. If you do not agree to these Terms, please do not use Bedtimey.

1. About Bedtimey

Bedtimey provides a personalized, continuing bedtime-story experience for families. Instead of disconnected one-off tales, Bedtimey delivers serialized bedtime-story chapters (typically 750–1,000 words per chapter) directly to the parent’s email inbox each evening ahead of bedtime.

Stories feature your child as the active protagonist exploring their unique, persistent Story World alongside beloved recurring animal companions, magical friends, kept promises, and gentle unfolding mysteries that settle peacefully into sleep.

Bedtimey uses advanced artificial intelligence and narrative software systems to craft and maintain these serialized chapters. Bedtimey is designed specifically to be managed by adults and read aloud to children at bedtime, supporting a cozy, screen-free listening ritual for kids.

2. Who May Use Bedtimey

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create a Bedtimey account, start a free trial, purchase a subscription or gift, or manage child profiles.

By using Bedtimey, you represent and warrant that:

• You are an adult age 18 or older;
• You are the parent or legal guardian of the child whose story preferences you provide, or you have received explicit authorization from the child's parent or legal guardian to create and manage the profile; and
• All information you provide to Bedtimey is accurate, truthful, and lawful.

Children are not permitted to create Bedtimey accounts, provide information directly to us, or make purchases.

3. Your Account & Security

When you create an account, you agree to:

• Provide accurate, current contact and billing information;
• Keep your account login credentials, password, and magic-login links secure;
• Maintain control over the email account associated with your Bedtimey profile; and
• Promptly notify us through our contact page if you discover or suspect unauthorized access to your account.

You may not create an account using false information or impersonate any other person or family. We reserve the right to suspend or terminate accounts that we reasonably believe are compromised, fraudulent, or operating in violation of these Terms.

4. Child Profiles & Data Minimization

Bedtimey family plans allow parents to create one or more child profiles (up to the limit of your chosen tier, such as 1 child or up to 3 children). Each child profile has its own independent Story World, Adventure history, character bible, and personalization settings. Creating a profile for a sibling does not automatically combine their fictional universes.

Please DO NOT submit sensitive personal identifying information into child profiles, including:

• Last names or full legal names;
• Home addresses or physical locations;
• School, daycare, or camp names;
• Telephone numbers;
• Photographs, videos, or voice recordings;
• Exact birth years or full birth dates (optional birthday celebrations require only the month and day); or
• Confidential medical, psychological, or health information.

5. Personalized and AI-Assisted Stories

Bedtimey uses specialized artificial intelligence models and narrative continuity engines to generate serialized chapters. All story generation is governed by our strict Bedtime Safety Constitution—prohibiting violence, jumpscares, nightmare imagery, and unresolved late-night peril—ensuring every chapter settles into a calm, comforting bedtime rhythm.

Because story content is generated with the assistance of artificial intelligence:

• Chapters may occasionally contain minor factual errors, continuity quirks, awkward phrasing, or unexpected interpretations of provided interests;
• Story plots may not always unfold in the exact manner anticipated; and
• Bedtimey is not a substitute for parental guidance or editorial discretion.

Parents and caregivers remain responsible for reading stories aloud and determining their suitability for their child. We reserve the right to adjust, filter, regenerate, or withhold content when reasonably necessary to maintain safety, quality, or system integrity.

6. Story Continuity & Lore Memory

Bedtimey is built around continuing multi-chapter narrative journeys (Adventures) within an ongoing Story World. Our system maintains an internal Story Bible that remembers recurring companions (like pets and forest guides), discovered locations, important objects, and kept promises.

Profile adjustments made in your parent dashboard (such as updating favorite interests or adding a new companion) apply to future generated chapters and do not retroactively alter previously delivered chapters. While our continuity engine is rigorously designed to preserve your family’s fictional history, we do not warrant that story continuity will be flawless in every generated sentence.

7. Nightly Story Delivery & Bedtime Schedules

Chapters are delivered primarily by email to the parent's registered email address according to your selected bedtime delivery time (e.g., 7:30 PM in your family’s local timezone). Parents can also view chapters through private, authenticated chapter links and their account dashboard.

We make every reasonable effort to ensure timely delivery ahead of your family's bedtime routine. However, exact delivery times cannot be guaranteed due to factors outside our direct control, including:

• Third-party email service provider queues or spam filtering;
• Internet network latency, mobile outages, or cloud hosting interruptions;
• Upstream AI provider availability or API maintenance; or
• Incorrect timezone or delivery settings in your account profile.

Occasional delivery delays do not constitute a material breach of contract or entitle a subscriber to an automatic refund. If you ever experience a missing chapter, our system allows on-demand chapter viewing in your dashboard, and our support team via our contact page is always happy to assist.

8. Subscription Plans & Free Trials

Bedtimey offers recurring subscription plans (such as $5.99 billed monthly or $49 billed annually) and multi-child family tiers. Current plan features, limits, and pricing are clearly displayed during checkout.

Free trials are limited to one trial per household. Creating multiple accounts or using temporary email addresses to circumvent trial limitations is strictly prohibited. Adding additional child profiles during a trial period uses your family trial and does not reset or extend the trial duration.

9. Billing, Automatic Renewal & Payments

Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) until cancelled. By starting a paid subscription, you authorize Bedtimey (through our secure payment processor, Stripe) to charge your payment method on file the applicable recurring subscription fee, plus any applicable taxes, on each renewal date.

Payment processing is handled directly by Stripe in accordance with PCI-DSS Level 1 compliance. Bedtimey does not store raw credit card numbers or security codes on our servers. You agree to keep your payment details valid and up to date.

If an automatic renewal payment fails, we may attempt to re-bill your card over subsequent days. If payment cannot be completed, we may pause story delivery until payment is resolved.

10. Price Changes

We may occasionally adjust subscription pricing. Any price change will not apply to your current billing period. If we change renewal pricing for an existing plan, we will provide you with reasonable advance written notice (typically at least 30 days via email) before the new price takes effect. If you do not wish to continue at the adjusted rate, you may cancel before the renewal date.

Grandfathered rates, early-adopter beta pricing, and special founding-member promotional pricing remain subject to the specific terms disclosed when redeemed.

11. Cancellation & Story World Preservation

You may cancel your subscription at any time with one click from your parent dashboard or by reaching out through our contact page.

When you cancel:

• Automatic billing is stopped immediately for future billing cycles;
• You will continue to receive nightly chapters through the end of your currently paid billing period; and
• Your child's Story World is preserved: Cancelling your subscription does NOT erase your child’s story universe, characters, or past adventures. If your family takes a break for summer or travel and resubscribes later, Emma's story world can resume seamlessly.

If you wish to permanently delete your child's Story World and all account records, you may request permanent deletion anytime via your account settings or by contacting our team via our contact page in accordance with our Privacy Policy.

12. Refunds

Subscription payments are non-refundable for partially used billing periods once a renewal cycle has begun. We do not provide prorated refunds for mid-cycle cancellations.

However, if you experience duplicate billing, an unintended charge, or an unresolved technical failure that prevented story delivery, please reach out through our contact page. We are parents too, and we will review your request in good faith and issue an appropriate adjustment or refund where warranted.

13. Gift Purchases & Prepaid Memberships

Bedtimey allows customers (such as grandparents, family members, or friends) to purchase prepaid gift memberships (e.g., 3-month, 6-month, or 12-month plans).

• One-Time Upfront Payment: Gift memberships are paid in full at purchase and do not automatically renew on the giver’s payment card;
• Recipient Control: The recipient family activates their gift using a secure claim token. The recipient family creates their own private account and customizes their child’s Story World;
• Privacy Protection: Gift purchasers do not gain access to the recipient family’s private story text, child preferences, or dashboard account unless the recipient family chooses to share chapters directly; and
• No Hidden Obligations: When a gift period expires, story delivery concludes peacefully unless the recipient family independently chooses to subscribe.

14. Permitted Household Use of Stories

Stories created through Bedtimey are provided exclusively for your family’s personal, household, non-commercial use.

You and your family are warmly encouraged to:

• Read chapters aloud together at bedtime;
• Print chapters on paper for bedtime reading or family binders;
• Save digital copies of delivered chapters for your personal family archives; and
• Share individual chapters privately with grandparents or close family members.

You are strictly prohibited from:

• Selling, reselling, or commercially exploiting Bedtimey chapters or story content;
• Publishing or distributing Bedtimey stories publicly online, in printed books, or in commercial compilations;
• Feeding, uploading, or submitting Bedtimey stories or story prompts into artificial intelligence models, machine learning datasets, or competing generative services;
• Scraping or harvesting story text using automated tools; or
• Removing Bedtimey trademarks or claiming Bedtimey proprietary systems as your own.

15. Intellectual Property Rights

The Bedtimey service, website, software, narrative continuity architecture, Story Bible memory algorithms, logos, illustrations, trademarks, and user interfaces are the proprietary property of Bedtimey and its licensors, protected by United States and international copyright, trademark, and trade secret laws.

These Terms grant you a limited, revocable, non-exclusive, non-transferable license to access and use Bedtimey strictly for your family’s personal bedtime reading in accordance with these Terms.

16. Generated Story Content

Subject to your compliance with these Terms, your household retains full freedom to enjoy, read, print, and cherish the personalized story chapters generated for your children.

Because story prose is synthesized through artificial intelligence, Bedtimey does not grant exclusive intellectual property rights or ownership in generic tropes, common phrasing, recurring mythical concepts, fairy-tale motifs, or settings that may independently appear in stories generated for other families.

17. User-Provided Information & Permissions

You retain all ownership of the profile information, child preferences, and feedback you submit to Bedtimey. By submitting preferences, you grant Bedtimey a limited license to store, process, and transmit that information solely to create your family’s stories, preserve narrative continuity, send bedtime emails, and maintain the service.

We do not sell your family’s personal information or share child profile details with third parties for advertising or marketing.

18. Prohibited Conduct

You agree not to:

• Use Bedtimey for any unlawful, harassing, or fraudulent purpose;
• Submit profile information that contains hateful, obscene, sexually explicit, or violent content;
• Attempt to prompt or manipulate Bedtimey’s systems into generating inappropriate or harmful material;
• Circumvent, bypass, or tamper with security measures, signed access links, or authentication tokens;
• Interfere with the operation of our servers or networks through automated attacks, bot scripts, or denial-of-service attempts; or
• Reverse engineer, decompile, or attempt to extract the source code or proprietary prompt engineering of Bedtimey.

19. Private Story Access & Signed Links

Bedtimey chapters are private to your family. We use cryptographic signed tokens to enable direct, one-click reading links in your nightly email without requiring daily login hurdles. You are responsible for maintaining the privacy of your email inbox and for not sharing private story URLs on public forums.

20. Third-Party Service Providers

Bedtimey relies on trusted, industry-leading third-party cloud infrastructure to deliver our service, including Stripe (payments), Resend (transactional email delivery), enterprise cloud hosting, and enterprise foundation AI model providers (Anthropic, Google).

We select partners committed to enterprise-grade data security. However, Bedtimey is not legally liable for temporary service interruptions, network outages, or delivery failures originating solely within third-party carrier or provider systems beyond our reasonable control.

21. Service Evolution & Feature Updates

We are continually enhancing Bedtimey to create richer, more magical bedtime experiences for families. We reserve the right to update, modify, expand, or discontinue specific features, chapter formatting, delivery options, or dashboard tools over time.

If we make a fundamental change that materially impairs a service you have already paid for, we will provide advance notice and offer a fair remedy or cancellation opportunity.

22. Suspension or Termination

We reserve the right to suspend or terminate your account or access to Bedtimey if you materially breach these Terms, engage in payment fraud, abuse our services, or compromise system security.

You may stop using Bedtimey at any time. Provisions of these Terms that by their nature should survive termination—including intellectual property restrictions, disclaimers, limitations of liability, and dispute resolution—will remain in effect.

23. No Professional or Medical Advice

Bedtimey stories are created strictly for family bedtime entertainment, comfort, and imaginative enjoyment.

Story elements that touch upon gentle growth themes (such as bravery, kindness, sharing, overcoming nighttime fears, or sleep routines) are fictional creative storytelling. Bedtimey does not provide medical advice, pediatric behavioral therapy, psychological treatment, or professional educational counseling.

24. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, BEDTIMEY IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. BEDTIMEY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT (A) BEDTIMEY WILL OPERATE UNINTERRUPTED OR ERROR-FREE; (B) EVERY CHAPTER WILL BE DELIVERED AT AN EXACT MINUTE; (C) GENERATED NARRATIVES WILL SATISFY EVERY INDIVIDUAL TASTE; OR (D) DEFECTS WILL BE IMMEDIATELY CORRECTED.

25. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEDTIMEY, ITS FOUNDERS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE BEDTIMEY.

IN NO EVENT SHALL BEDTIMEY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO BEDTIMEY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

26. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bedtimey, its operators, officers, and contractors from and against any third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or related to:

• Your material violation of these Terms;
• Information, preferences, or materials submitted by you without proper legal authorization; or
• Your intentional misuse or unlawful conduct in connection with the service.

27. Governing Law

These Terms, and any disputes arising out of or relating to these Terms or the Bedtimey service, shall be governed by and construed in accordance with the laws of the State of Delaware and the applicable federal laws of the United States of America, without giving effect to any principles of conflicts of law.

28. Informal Dispute Resolution

We want every family's experience with Bedtimey to be delightful. If you encounter any problem, dispute, or concern regarding our service, you agree to first contact our support team through our contact page before initiating any formal legal proceeding.

Both you and Bedtimey agree to use good-faith, reasonable efforts to resolve any dispute informally within thirty (30) days of initial notice. Most customer concerns can be resolved quickly and amiably in this manner.

29. Consumer Rights & State Disclosures

Nothing in these Terms limits or waives any non-waivable statutory consumer protections available to you under applicable state or federal law.

Bedtimey complies with state automatic-renewal laws (including California Business and Professions Code § 17600 et seq. and equivalent state statutes). Subscribers may cancel their automatically renewing subscriptions at any time through our self-service parent dashboard or by contacting support.

30. Changes to These Terms

We may update these Terms from time to time to reflect product enhancements, legal updates, or operational changes. When revisions are made, we will update the “Last updated” date at the top of this document.

For material revisions that affect existing active subscriptions, we will provide reasonable advance notice via email or a prominent notification in your parent dashboard. Your continued use of Bedtimey after updated Terms become effective constitutes your acceptance of the revised Terms.

31. Entire Agreement & Severability

These Terms, together with our Privacy Policy and any specific promotional or checkout terms agreed to at the time of purchase, constitute the complete and exclusive agreement between you and Bedtimey regarding the service.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be severed or interpreted to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
